Lasting Power of Attorney


It is so easy to assume that we will always be able to do the things that we do. However, human life is fragile and so is our 'capacity' to make decisions. The most obvious situation that comes to mind in terms of making our own decisions is dementia or other infirmity. However, whilst these are real concerns because, by the time this occurs, it is too late to hand over decision making to a family member such as your spouse and/or child, the truth is that incapacity to conduct one's own affairs can occur at any age. Accident, illness or other unforeseen health situations can result in us being temporarily 'out of action' which means that we can't access our bank accounts, can't make important financial decisions or alternatively acting so as to bring a particular financial situation to an end.


This is where a lasting power of attorney steps in to rescue the situation because, as financial commentators have said many times, this document can be more important than a will in that it enables a person who is still living to be assisted by their appointed 'helper'. However, the catch is that in order to take advantage of such a document, you must first have made sure that it was in place IN ADVANCE of your health situation arising.
